LICENCE AGREEMENT |
|
1. Ця Ліцензійна угода (надалі – «Договір») має статус електронного договору, в тому розумінні, в якому його визначено у статті 3 Закону України «Про електронну комерцію» та регулює відносини між Користувачем та Ліцензіаром, пов’язані із використанням комп’ютерної програми SmAc Mini (надалі - «Програма»). |
1. This License Agreement (hereinafter the "Agreement") has the status of an electronic contract, as it is defined in Article 3 of the Law of Ukraine "On Electronic Commerce" and regulates the relationship between the User and the Licensor related to the use of the SmAc Mini software product (hereinafter the "Software").

2. Користувачем, за цим Договором виступає особа, яка здійснила встановлення Програми на власному пристрої, що дозволяє її використання за цільовим призначенням. |
2. The User, under this Agreement is a person who has installed the Software on its own device that allows its use for its intended purpose.

3. Ліцензіаром за цим Договором виступає ТОВ «Кадрова агенція «Ві Ай Пі Персонал», якій належать авторські майнові права на програму у зв’язку з її створенням. |
3. The Licensor under this Agreement is the LLC “Recruitment Agency “VIP Personnel” which is vested in the author’s proprietary rights (copyright) to the Software as the result of its creation.

4. Цільове призначення Програми – здійснення фінансового та управлінського обліку операцій Користувача, а також отримання консультацій юриста та/або бухгалтера, пов’язаних із підприємницькою діяльністю Користувача. |
4. The designated purpose of the Software is to carry out financial and management accounting of the User's operations, and as well as to obtain piece of legal and/ or accountant advice related to the User's business activities.

5. Встановлення особою Програми на власному пристрої вважається погодженням такою особою всіх умов даного Договору та укладенням такого Договору із Ліцензіаром. |
5. Upon the moment when the Software has been installed by a person on its own device, all conditions hereunder are deemed to be agreed by such person and this Agreement is deemed to be concluded with the Licensor.

6. У результаті укладення цього Договору Ліцензіар надає дозвіл, а Користувач набуває невиключне право - на використання Програми за її цільовим призначенням способом відтворення Програми на власному пристрої. При цьому, за Ліцензіаром зберігається право на використання Програми і на передачу невиключного права на використання Програми іншим особам, а також право забороняти особам використання Програми. |
6. As a result of concluding this Agreement, the Licensor grants permission, and the User acquires the non-exclusive right to use the Software for its designated purpose by its reproduction on its own device. At that, the Licensor retains the right to use the Software and to sublicense the non-exclusive right to use the Software to other persons, as well as the right to prohibit persons from use of the Software.

7. Реєстрація Користувача, з метою визначення правомірності користування Програмою, здійснюється на основі наданих ним відомостей у процесі встановлення Програми. |
7. User’s registration, in order to determine the validity of use of the Software, is performed on the basis of information provided by him during the installation of the Software.

8. Термін дії ліцензії (дозволу) на використання Програми обмежується оплаченим періодом її використання. |
8. The term of the license (permission) to use the Software is limited to the paid period of its use.

9. The amount, terms and conditions of payment for the use of the Software are set forth on the Software’s page on the Google Play platform and App Store at the following links: https://play.google.com/store/apps/details?id=com.vip_consulting.smac_mini&hl=ru&gl=US https://apps.apple.com/us/app/smac-mini/id1519001736#?platform=ipad .

10. Територія використання Користувачем Програми не обмежена.

10. The territory of use of the Software by the User is not limited.
|
|
11. Користувачі, які здійснили встановлення безкоштовної версії Програми на власному пристрої, набувають усіх прав та обов’язків Користувача, за винятком тих видів використання, які можливі виключно у платних версіях Програми.

11. Users who have installed a free version of the Software on their own device acquire all rights and obligations of the User, except for those certain types of use that are possible only in paid versions of the Software.

12. Програма є такою, якою Користувач бачить її у певний момент часу і якою вона для останнього доступна. |
12. The Software is of that kind that the User sees at a certain time point and as it is available to the latter.

13. Дія ліцензії (дозволу) на використання Програми припиняється у випадку порушення Користувачем авторських прав Ліцензіара, а також у випадку не здійснення Користувачем оплати за використання Програми в порядку, визначеному п.9 даного Договору.

13. Licence (permission) to use the Software is terminated in case the User violates the copyright of the Licensor, as well as in case the User fails to pay for the use of the Software due to paragraph 9 of this Agreement.

14. Ліцензіар залишає за собою право без погодження із Користувачем вносити будь-які зміни та доповнення до даного Договору, та зобов’язується повідомляти Користувача про внесені зміни/доповнення на сторінці Програми на платформі Google Play та App Store за посиланнями: https://play.google.com/store/apps/details?id=com.vip_consulting.smac_mini&hl=ru&gl=US https://apps.apple.com/us/app/smac-mini/id1519001736#?platform=ipad . |
14. Licensor reserves the right to make any alterations and amendments to this Agreement without the consent of the User, and undertakes to notify the User of any changes / additions on the Software page on the Google Play platform and App Store at the following links: https://play.google.com/store/apps/details?id=com.vip_consulting.smac_mini&hl=ru&gl=US https://apps.apple.com/us/app/smac-mini/id1519001736#?platform=ipad .
